Consumer provisions common to the statutory warranty and the supplemental warranty. For product end users who are classified as “consumers” vis-à-vis the party from whom they purchased the product (hereafter the “End User”), Quadro S.r.l. provides a “supplemental warranty” as described below, which is intended to be in addition to and not in lieu of the consumer’s other warranty rights based on implementation of Directive 1999/44/EC (hereafter the “statutory warranty”). The product purchase date that triggers the statutory warranty and then the supplemental warranty is based on the tax document (invoice or final purchase receipt) issued to the End User at the time of purchase/installation. If the products are sold along with the building, this date is based on the purchase document for the building showing that the products were already included. Without appropriate documentation of the purchase and the relative date, the statutory and supplemental warranties will not be effective, unless Quadro S.r.l. determines otherwise. In particular, “consumer” means exclusively a natural person whose actions are for purposes unrelated to any business, commercial, artisan, or professional activities, according to the definition under Directive 1999/44/EC. This supplemental warranty therefore does not apply to other purchasers and/or end users with a different classification and characteristics. Supplemental warranty means the provision of an additional warranty period to the End User beyond the one provided in the statutory warranty, exclusively for free repair and/or replacement of the parts under warranty found to be defective under the conditions described below. In any case, Quadro S.r.l. may, at its discretion, replace the defective product with a product of similar or higher quality. The supplemental warranty thus in no case covers the costs of labor, service calls, or assistance at the End User’s domicile.
The subject and duration of the supplemental warranty’s extension beyond the statutory warranty are as follows:
– For defects on stainless steel: extension of 8 years (and no more than 10 years of total warranty, including statutory warranty)
– For manufacturing or design defects: extension of 3 years (and no more than 5 years of total warranty, including statutory warranty)
– For defects in all finishes and materials: 2 years of statutory warranty
– For cartridges and large screws, electrical components and all “consumable” components or components subject to wear, only the statutory warranty is confirmed (normally 2 years). The terms go into effect upon expiration of the statutory warranty, which is calculated from the date the End User purchased the products.
Defective products and/or components will be repaired or replaced only after being sent to the retailer or authorized service centers. Any amendment and/or addition to this supplemental warranty may be issued only by Quadro S.r.l. and must be in writing. In case of replacement and/or repair and/or other assistance provided while the statutory and supplemental warranties are in effect, a new warranty period will begin to run and the product replaced/repaired or which underwent maintenance will be covered for the remaining period of validity of the original warranty.
Defects under the supplemental warranty must be reported within 60 days after their discovery. If this occurs after the supplemental warranty expires, this deadline is reduced to 15 days after expiration of the supplemental warranty.
All products and/or parts replaced by Quadro S.r.l. will become its property.
If the End User makes a purchase (either offline or online) from a retailer located in a country other than the place of product installation, the End User will have the right to a statutory warranty only, and thus not to a supplemental warranty. Regardless of the classification of the End User and/or purchaser, Quadro S.r.l. will in no case be liable in case of:
– improper use, installation, maintenance and/or cleaning
– negligence, damage, deterioration, lightning, weather events
– over-voltages, insufficient power, acts of God, wear and tear
– damage during transport or by third parties
– non-compliance with local technical or safety regulations
Additional exclusions:
– modifications or non-original accessories
– use of non-original Quadro S.r.l. spare parts
– freezing, impurities, foreign bodies, hard water damage
– use of aggressive, acidic or abrasive cleaners
– chemical or electrochemical deterioration
– high salinity/chlorine, sand, or debris in water
– missing filters, incorrect pressure or temperature
– unauthorized repairs or assistance
Quadro S.r.l. declines any liability for direct or indirect harm to people, property, or animals caused by failure to comply with product care instructions. If products are resold abroad, the supplemental warranty does not apply. Responsibility toward the end user falls entirely on the retailer. Only the statutory warranty under Italian Civil Code articles 1490 et seq. applies between Quadro S.r.l. and the initial purchaser.
Requests for product replacement under warranty will be accepted only upon presentation of a dated document proving the purchase of the product. All returns due to defective products or order/shipping errors must be previously authorized in writing by Quadro S.r.l. Each return authorization will be assigned a specific reference number. All authorized returns must be shipped at the sender’s expense within no more than 15 days from the date of authorization.
The following will not be accepted:
– Returns without documented written authorization
– Returns inadequately packaged to prevent damage during transport
– Disassembled products
– Dirty or unclean products
– Thermostatic products returned without filters
Quadro S.r.l. will examine each case individually and assess whether the conditions for warranty coverage are met, reserving the right to refuse repair or replacement if grounds for exclusion are identified. Should the reported defects not be confirmed upon inspection, the customer will be notified accordingly, and the products will be held at their disposal for 30 days from the date of notification. After this period, the products will be scrapped. Shipping costs for returning the defective product shall be borne by the customer. This warranty applies solely to the extent explicitly stated above and is subject to compliance with the aforementioned requirements.
